Copyrights to all content on the Site belong to Mark Japan. Reproduction or use of any content on the Site without prior authorization is prohibited.
These Terms govern the use of the Site. Mark Japan’s Terms of Trade govern all transactions unless Mark Japan signs a separate written agreement with you.
Only the English version of these Terms is authoritative. Non-English translations are provided for convenience and are not legally binding.
To make transactions on the Site, you must register for a Mark Japan customer account. Registration is free of charge. You are required to provide Mark Japan with accurate, complete, and current information. Mark Japan is not liable for any loss arising from inaccurate or incomplete information. Once you receive your login credentials, you can view prices and make transactions.
Transactions are governed by the Terms of Trade issued with the invoice. Products listed on the Site are priced in EUR, GBP, JPY, or USD, and unless otherwise stated in writing, are offered on CFR or FOB terms. Mark Japan accepts payment only in the currency stated on the invoice. Bank charges and other transaction costs are not included in the invoice price and are your responsibility.
Mark Japan exercises care in posting information on the Site; however, Mark Japan makes no warranty regarding the completeness, accuracy, validity, safety, or up-to-dateness of such information. Mark Japan will not be liable for any loss arising from actions or decisions made based on information from the Site.
Mark Japan provides the Site and its content "as is." To the maximum extent permitted by law, Mark Japan excludes implied warranties in connection with the use of the Site or the inability to use it, and also excludes liability for any consequential, indirect, or punitive damages, including lost business, profit, or use.
Abuse includes, but is not limited to, creating multiple or fraudulent customer accounts, violating applicable laws, these Terms, or Mark Japan's policies, or engaging in fraudulent or bad faith activities. Mark Japan may suspend or cancel abusive customer accounts without notice. You agree to indemnify Mark Japan for any loss arising from your breach of these Terms, negligence, wrongdoing, or violation of third-party rights or laws.
Mark Japan does not engage in transactions with organized crime and maintains internal policies to prevent anti-social transactions. This includes screening business partners for affiliations with anti-social forces and incorporating exclusionary terms in procurement and sales contracts. Transactions that violate these policies are prohibited.
Mark Japan complies with both domestic and international security and anti-terrorism laws and regulations, including list controls and catch-all controls prohibiting payments to sanctioned countries, individuals, or for embargoed goods (e.g., weapons and nuclear materials). Transactions that contravene these regulations are prohibited.
A forbearance in exercising or requiring satisfaction of a provision, act, omission, course of dealing, or performance will not waive a right, remedy, or condition. If any part of these Terms is held unenforceable, the rest shall remain effective as written, except where held unenforceable. These Terms are governed by the laws of Japan, and any disputes will be adjudicated by the courts in Japan.
